Attorney General's Memorandum

New Jersey property owners need to be aware of the federal and state laws against discrimination. The Attorney General's memorandum outlines the New Jersey Law Against Discrimination to ensure that equal housing opportunities are provided for all.

Section 11:5-6.4 (d) 3(j) requires that at the time of the taking of any listing of residential property, a licensee shall furnish to the owner a copy of a summary of the New Jersey Law Against Discrimination N.J.S.A. 10:5-1 et seq. (commonly known as the Attorney General's memorandum). The purpose of the memorandum is to help owners, as well as licensees, comply with the New Jersey Law Against Discrimination and federal laws that prohibit discrimination in the sale or rental of real estate.

The Revised Attorney General Memorandum as of July 2010. Please note the following changes:

1) The letter is dated July 2010;
2) There is new letterhead: Governor Chris Christie, Lt. Governor Kim Guadango, Attorney General Paula T. Dow and Director Chingh Q. Le, Esq.;
3) Page 2, there is a new section 1-4 noting that the Division takes the position that certain actions may violate New Jersey's Law Against Discrimination (LAD) and/or federal civil rights housing laws;
4) The memo is now 3 pages;
5) The memo is signed by Paula T. Dow, Attorney General and Chingh Q. Le, Director
